PRIVACY POLICY
Effective Date: January 1, 2024
TH³, Inc. ("TH³," "we," "our," or "us") respects your privacy and is committed to protecting the personal information of our users ("you," "your"). This Privacy Policy describes how we collect, use, store, and disclose information about you—particularly as it relates to pet health records, subscription details, payment information, location data, and any other personal data we obtain. By accessing or using TH³'s website, mobile application, or related services (collectively, the "Service"), you consent to the data practices described herein.
1. SCOPE & APPLICATION
1.1 Who We Are
TH³ is a Delaware C-Corporation that operates a pet health management platform in the United States (with potential expansions in North America). TH³ is not a veterinarian, healthcare provider, or insurer, nor do we handle human medical records subject to HIPAA. However, we treat all user and pet-related data with care and confidentiality, in line with applicable data protection laws such as the California Consumer Privacy Act (CCPA), Personal Information Protection and Electronic Documents Act (PIPEDA) (for Canadian residents, if any), and general U.S. consumer protection laws.
1.2 Eligibility
We only collect personal information from individuals 18 years of age or older who create accounts for the purpose of managing pet health data. If you are under 18, do not use or attempt to use our Service. By using the Service, you represent that you meet the age requirement and the other eligibility criteria in our Terms of Service.
1.3 Agreement to Terms
By accessing the Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy and our Terms of Service. If you do not agree, you must not use the Service or provide any personal information to TH³.
2. DATA WE COLLECT
2.1 Types of Personal Information
We collect or receive from you, or on your behalf, the following categories of information:
- Account Data: Name, email address, phone number, password, login credentials, address, and other contact details used to register an account or subscribe to our Service.
- Pet Health Records: Information about your pets, including medical history, vaccination status, health logs (appetite, stool, water intake, mood, etc.), diagnosis details, medications, and other health-related data you choose to provide.
- Payment Information: Credit card or other billing details (processed through PCI-compliant third-party payment processors; we do not store the full card number).
- Location Data: Approximate or precise geolocation if you grant permission (e.g., for vet clinic recommendations or location-based analytics).
- Technical Usage Information: Device and network data (IP address, browser type, device type, unique identifiers), usage logs (how and when you interact with the Service), and related metadata.
2.2 Sources of Data
- You Directly: Via account registration, daily logs, pet profile creation, or subscription sign-up.
- Third Parties: If you connect TH³ to a veterinary clinic or insurance provider, or if you integrate with external apps, we may obtain data from those sources with your authorization.
2.3 Collection of Sensitive Data
We primarily collect pet health data, which typically falls outside HIPAA's scope because it does not concern human patients. Nevertheless, we handle all personal and health-related data with strict security measures described below. If we inadvertently collect human health data (for instance, if you mistakenly upload human medical records), we will treat it as sensitive and attempt to delete or secure it upon notice.
3. HOW WE USE YOUR INFORMATION
3.1 Service Provision & Personalization
We use your data to:
- Provide daily logging functionality and analytics.
- Generate AI-driven alerts and insights regarding potential pet health risks.
- Schedule veterinary appointments at your or the system's request.
- Personalize user experience (e.g., recommended diet changes for specific conditions).
3.2 AI & Algorithmic Processing
TH³ applies machine learning algorithms, including large language model (LLM) workflows, to interpret your pet's data, detect anomalies, and produce recommendations or suggestions. These AI-driven outputs are strictly informational; they are not a substitute for professional veterinary advice. By using TH³, you expressly consent to these AI-based analyses.
3.3 Subscriptions & Payment
If you subscribe to Standard or Premium tiers, we process payment information to bill you for monthly or annual fees, manage your subscription, and provide relevant premium features. We use third-party payment processors who comply with industry security standards (e.g., PCI DSS). We retain basic transaction records for legal obligations (e.g., tax, accounting) and internal analytics.
3.4 Communications
We may send you administrative or service-related communications (e.g., confirmations, reminders, updates) and marketing or promotional messages (subject to your consent where required by law). You can typically opt out of marketing emails at any time but may continue receiving essential transactional messages.
3.5 Research & Development
We analyze usage trends and aggregated or de-identified user data to improve TH³'s ML models, user experience, and future service offerings. Any results of such analysis that are disclosed externally will not identify you personally.
3.6 Legal Compliance & Enforcement
We may use or disclose data to comply with valid legal process or as required by law enforcement or other authorities. We also use data for fraud detection, to protect user accounts, and to enforce our Terms of Service.
4. DISCLOSURE & SHARING OF DATA
4.1 Service Providers
We share data with trusted vendors who perform tasks on our behalf (hosting, payment processing, email distribution, analytics, AI infrastructure). They must abide by confidentiality and security obligations and use data only as necessary to provide their services.
4.2 Vet Clinics & Insurance Providers
If you choose to link your account to a veterinary clinic or insurer, we will share relevant pet health data with them at your direction. For instance, if an AI alert suggests scheduling an appointment, we may transmit your pet's logs to a partner clinic so they can prepare. Similarly, to obtain pet insurance quotes or integrate coverage details, we may share necessary details with your chosen insurer.
4.3 Affiliates & Corporate Transactions
In the event of a merger, acquisition, financing, due diligence, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction, subject to appropriate confidentiality agreements. If TH³ is acquired by or merges with another entity, that entity will assume the rights and obligations regarding your personal data as described in this Policy.
4.4 Aggregated & De-Identified Data
We may share aggregate or anonymized data that cannot reasonably identify you. For example, we might publish pet health statistics or user trends for industry research or marketing, but these datasets contain no personal identifiers.
4.5 Legal Requirements
We may disclose information if required by law, subpoena, or court order, or if we believe disclosure is necessary to protect our rights, safety, or property, or that of users or third parties.
5. DATA SECURITY & RETENTION
5.1 Security Measures
TH³ uses commercially reasonable administrative, technical, and physical safeguards to protect personal data from unauthorized access, alteration, disclosure, or destruction. These measures include encryption at rest and in transit, access controls, intrusion detection, and regular security audits. However, no system can be guaranteed 100% secure; you acknowledge any data transmission bears inherent risks.
5.2 Data Retention
We retain personal data and pet health records for as long as needed to fulfill our legitimate business purposes and comply with legal obligations. Upon account deletion, we generally remove your data from active systems, but may retain copies for backup, archival, or legal compliance for a limited time.
5.3 International Transfers
If you are located outside the U.S., you understand that your personal data may be transferred to and processed in the U.S. (where data protection laws might differ from your home jurisdiction). By using TH³, you consent to this transfer and processing.
6. USER RIGHTS & CHOICES
6.1 Access & Correction
You may access and edit your account profile or pet logs at any time by logging into TH³. For further requests (e.g., receiving a copy of all data), contact us at Contact@total-h3.com. We will respond to valid requests within the timelines required by applicable law.
6.2 Deletion & Consent Withdrawal
You may request deletion of your data or withdraw your consent for certain data uses. If you do so, certain features may no longer be available. We will remove or anonymize your personal data unless retention is required for legitimate business or legal reasons.
6.3 CCPA & PIPEDA Rights
If you are a resident of California or Canada, additional rights or processes may apply, as described in the "User Rights" section of our Terms of Service or in local addendums. We strive to honor all verifiable requests in compliance with relevant laws, including not "selling" personal data under CCPA.
6.4 Opt-Out
For marketing emails, you can opt out via the "unsubscribe" link in the message. We will continue sending essential service or transactional emails (like subscription confirmations or policy updates).
7. HIPAA COMPLIANCE DISCLAIMER
TH³ handles pet health data, which is not typically governed by HIPAA. We do not provide human healthcare services. Therefore, HIPAA is not applicable in most circumstances. However, we apply HIPAA-like security standards out of caution, ensuring robust data protection. If you or any partner clinic believe HIPAA or related regulations might apply, please reach out so we can clarify and ensure compliance.
8. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect evolving laws, practices, or service enhancements. The "Effective Date" indicates the latest revision. If we make material changes, we will notify users via email or a prominent notice on our site before the change takes effect. Continued use of the Service after updates become effective constitutes acceptance of the revised Policy.
